Lеgal issue: the constitutionality of a rule according to which the step-mother of a military man is not entitled to an allowance and compensation on occasion of his tragic death in the army, even though she brought him up.
Ratio decidendi: the contested rule does not contradict the Constitution. The step-mother may claim other benefits, such as pension in connection with the loss of bread-winner and payments under mandatory life insurance of military personnel. She is not also deprived of the legal opportunity to use respective monetary means paid to the father of the military man (her husband), if she is still married to him. Yet, there can be life circumstances when such payments do not guarantee to her an adequate compensation for harm sustained. Therefore, the federal legislator may extend analogous social benefits to a step-mother as a person who substituted mother to a deceased military man.
