Legal issuе: the constitutionality of provisions which deprive the owner of a share in an agricultural land plot of the possibility to independently determine the location of the parcel of land which was apportioned to him in kind in exchange for his share.
Ratio decidendi: the Court found that the contested provisions do not contradict the Constitution and in reality do permit the apportionment of a land parcel without regard to an earlier decision of general meeting of shareowners which have defined the part of commonly owned land plot earmarked for priority apportionment.
