Legal issue: whether a differentiation as to the ways of providing new housing to citizens who voluntarily left Chernobyl zone and were registered before or after 1 January 2005 as being in need of improvement of their housing was constitutional?
Ratio decidendi: the Court came to conclusion that the contested regulation, under which the citizens who were registered as being in need of improvement of their housing conditions after 1 January 2005 were not guaranteed housing by way of granting a subsidy from the federal budget – as opposed to those who were registered before that date – does not correspond to the Constitution because it leads to unjustified distinctions as to the volume of social rights of these two categories of citizens.
