Decree of the Plenary Session of the Supreme Court of 3 December 2013 № 33 on sentencing for corruption crimes

The decree is devoted to multiple fines for corruption crimes. It requires courts to find out, prior to the imposition of such fine, the ability of the convicted person to pay it. Courts must take into account not only the gravity of the crime, but also the financial situation of the convicted person and his family. The shortage of money does not exonerate the convicted person for the failure to pay fine on time. Multiple fines imposed for corruption crimes may be substituted in such case with an alternative punishment envisaged by the Criminal Code for the crime in question (as a rule, it is the deprivation of liberty). Such punishment may not be conditional (i.e. subject to probation).
