Judgment of the Constitutional Court of 22 November 2013 № 25-П on the review of constitutionality of Article 2 of the Federal law “On Making Changes to the Federal law “On the Status of the Military Personnel” and on the Provision of Housing Premises to Certain Categories of Citizens” in connection with the complaint of citizen Terentiev

Court:: Constitutional Court

Legal issue: constitutionality of the rule which conditions the provision of housing to former policemen at the expense of federal budget upon the date of their retirement from service in the police (not later than 1 January 2005).

Ratio decidendi: the contested regulation does not conform to the Constitution. It does not have an objective and reasonable justification and violates prohibition against different treatment of persons being in the same or similar situations.
